Terms of Service

These terms apply when you join or use a loyalty club (“Club”) that a restaurant, brewery or other venue (“Venue”) runs on the VIP Guests platform, at an address like venue-name.vipguests.ca. VIP Guests (“we”, “us”) is a sole proprietorship based in Torrance, California, USA. By joining a Club you agree to these terms and to our Privacy Policy.
Venues that use VIP Guests agree to a separate business agreement with us; these terms are for guests.
1. The service
VIP Guests provides the technology. Each Venue runs its own Club. It decides the membership tiers, prices, perks, rewards, offers and Daily Spin prizes, and is responsible for honouring them at the Venue. Questions about a specific reward or offer are best raised with the Venue first. You can also reach us at support@vipguests.ca.
2. Eligibility and your account
- You must be at least 13 years old. Clubs at venues that serve alcohol are only for people of legal drinking age in that state or province.
- You sign in with an email address or mobile number that you control, confirmed by a one-time code. Keep access to them secure: anyone who can receive your codes can use your membership.
- Give accurate information, and use one membership per person per Club.
3. Paid memberships and automatic renewal
- Before you pay: we show you the price, the billing period, what’s included, that the membership renews automatically until you cancel, and how to cancel. You must actively agree to the renewal terms to buy.
- Billing and renewal: paid memberships are billed in advance and renew automatically at the then-current price each billing period until you cancel. Payments are processed by Stripe. Promo codes apply as described when you redeem them.
- Notices: we send a confirmation by email after purchase. For memberships billed yearly, we send a reminder before each renewal. We will tell you in advance of any price change, and you can cancel before it applies.
- Cancelling: you can cancel at any time, online from your club card or by emailing support@vipguests.ca. Cancelling stops future renewals, and your membership stays active until the end of the period you paid for.
- Refunds: amounts already paid are not refunded, except where the law requires it or the Venue offers it.
4. Rewards, points and redemption
- Stamps, points and rewards have no cash value, cannot be sold or transferred, and can only be used at the Venue that issued them (or its other locations, if the Venue allows).
- Rewards may have expiry dates, which are shown on your club card. Expired rewards cannot be redeemed.
- To use a reward, open it on your club card or wallet card and swipe to redeem in front of Venue staff. Some rewards may also need a staff PIN. Once a reward is marked as redeemed it can’t be used again, so only redeem it when you are ready to use it. If a reward is redeemed by mistake, ask the Venue.
- Venues may change or end their rewards, offers and Club with reasonable notice. This won’t affect rewards already issued, which stay valid until their expiry date.
5. The Daily Spin
The Daily Spin is a free promotional feature. No purchase is necessary, and a purchase doesn’t improve your chances.
- It is limited to one spin per member per day.
- The Venue sets the prizes and odds, and they are shown in the Club.
- Prizes are as described, have no cash value and can’t be transferred.
- Where the law requires it, including in Canada, a winner may need to correctly answer a mathematical skill-testing question before claiming a prize.
- Void where prohibited.
6. Receipts and check-ins
Only upload receipts for your own purchases at that Venue, and only check in when you are actually there. Receipts are checked automatically and may be reviewed by the Venue. We or the Venue may refuse, reverse or remove points and rewards obtained through misuse, and may suspend the memberships involved. Misuse includes duplicate, altered or someone else’s receipts and false check-ins.
7. Text message program
- Program: each Venue’s club offers ("Venue name Club").
- Description: recurring automated marketing texts about member offers, new releases and rewards, sent to the number you provide only if you opt in.
- Frequency: message frequency varies.
- Cost: message and data rates may apply.
- Help: reply HELP or email support@vipguests.ca.
- Opt out: reply STOP at any time, or turn texts off on your club card. You will receive one confirmation and no further marketing texts.
Consent is not a condition of membership or purchase. Carriers are not liable for delayed or undelivered messages.
8. Email
If you opt in to email offers, you can unsubscribe at any time with the link in every email or on your club card. We will still send messages you request, such as sign-in codes and membership receipts.
9. Acceptable use
Don’t misuse the platform. That means no attempts to:
- access other people’s memberships or Venue tools;
- interfere with or overload the service;
- scrape it; or
- use it for anything unlawful.
10. Availability and changes
We work to keep the platform available but cannot guarantee it will be uninterrupted or error-free. We may update the platform and these terms. If we make significant changes to these terms, we will post them here with a new date and, where required, tell you before they take effect.
11. Liability
To the extent permitted by law, the platform is provided “as is”. VIP Guests is not liable for indirect or consequential losses, or for a Venue’s failure to provide a perk, reward or offer. Our total liability to you for any claim relating to the platform is limited to the greater of:
- the membership fees you paid in the 12 months before the claim; or
- 50 US dollars, or 50 Canadian dollars if you are in Canada.
Nothing in these terms limits rights you have under consumer protection law where you live that can’t be waived by contract.
12. Ending your membership
You may close your membership at any time from your club card or by emailing support@vipguests.ca. We or the Venue may suspend or close a membership that breaches these terms. Unredeemed rewards end when a membership closes.
13. Governing law and disputes
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Disputes will be heard by the state or federal courts located in Los Angeles County, California.
If you live in Canada or another country whose consumer protection laws give you the right to bring a claim where you live, or under your local law, you keep that right.
